GENERAL TERMS AND CONDITIONS OF CONTRACTING (Provision of Services) 

The current website, www.mohem.es, is owned by MOHEM (hereinafter referred to as "the Controller") with Tax ID number (CIF) 13413677P and registered address at EMILI POLIT, Nº 2, 08328, ALELLA, BARCELONA. 

The General Terms and Conditions of Contracting regulate the distance sales relationship between the Controller and the user or client, in accordance with the legal provisions, especially Law 7/1998, of April 13, on General Terms and Conditions of Contracting; Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users; Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016; Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights; Law 7/1996, of January 15, on Retail Trade Organization; and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce. 

The Controller reserves the right to make any modifications deemed appropriate, without prior notice, to the General Terms and Conditions. Such modifications may be made through its websites, by any legally admissible means, and shall be mandatory for as long as they are published online until replaced by subsequent valid modifications. Nonetheless, the Controller reserves the right to apply Specific Terms and Conditions of Contracting, taking precedence over these General Terms and Conditions when deemed appropriate, and will announce these in due time and form. 

The purpose of the website is commercial. 

The duration of the contract shall be linked to the completion of the contracted service without prejudice to the right of withdrawal. 

You may also subscribe to the newsletter to receive offers related to our services or general information that may be of interest. 

As a user or client, you explicitly declare that you are aware of, understand, and accept the terms of use and these General Terms and Conditions of Contracting. Similarly, you declare that you are of legal age and have the legal capacity necessary to access the Controller's websites and contract through them. 

To acquire our services, you can go to the corresponding section of our online store. 

It is an essential requirement to register as a user of the website to make purchases online. You can access the corresponding section for registration on the website itself. In accordance with Regulation (EU) 2016/679 and Organic Law 3/2018, the Controller informs users that the personal data collected during the registration process and subsequent purchases will be

processed under its responsibility, for the purpose of managing these actions by the user and carrying out subsequent actions derived from them. 

Additionally, the Controller informs you of the possibility of exercising the rights of access, rectification, deletion, restriction, portability, and opposition by writing to the address EMILI POLIT, Nº 2, 08328, ALELLA, BARCELONA or by email to info@mohem.es. 

Unless otherwise communicated, we will assume that your data has not been modified, that you commit to notifying us of any changes, and that we have your consent to use it in order to maintain the relationship between the parties. 

During the purchase process, you must identify yourself with the username and password provided. These details will not be made public. You are responsible for treating your identity and password obtained during registration as confidential and responsible, and you may not transfer them to another party. You can modify your registered information at any time in your client area. In this same section, you will have access to a history of your contracted services. This is only a consultation area but allows for management, enabling users to delete records they deem unnecessary to view. 

Upon completing the purchase process, the client will receive a confirmation by email. It is essential that the user provides a valid email address during the purchase process. All website content is in English 

Before the service is provided, the client will receive an email confirming the requested service. Once the service has been provided, the client will receive the corresponding invoice. Features, Offer, and Validity of Services 

The services offered in our online store include a detailed description of their essential characteristics. 

If a service is on offer, its price and validity will always be indicated alongside its essential characteristics. 

In compliance with current regulations, the Controller provides information on all its services, their characteristics, and prices. However, the Controller reserves the right to withdraw, replace, or change the services offered through the website by simply modifying the content thereof. Thus, the services offered at any given time on the website will be governed by the General Terms and Conditions of Contracting in effect in each case. Likewise, the company reserves the right to cease offering access to the aforementioned services at any time and without prior notice.

Guarantees 

All services offered on the website are covered by the corresponding guarantee based on the type of service and the time and form in which the services have been requested.

Prices 

All services indicate the sale price in Euros and include Value Added Tax (VAT). If any other tax applies, it will also be indicated. 

Payment Methods and Service Execution 

The client may pay for the service by choosing one of the following methods. During the purchase process, you must indicate your choice: 

Credit card (VISA or MASTERCARD) 

All operations involving the transmission of personal or banking data are carried out in a secure environment: a server using SSL (Secure Sockets Layer) technology. All transmitted data travels encrypted across the network. 

Additionally, your credit card details are entered directly on the bank's page (POS terminal) and are not entered or registered on the Controller’s server. 

When paying with VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiration date, and a Validation Code, which corresponds to the last three digits of the italicized number printed on the back of your VISA or MASTERCARD, thereby offering greater security guarantees for the transaction. This payment method is valid exclusively on the website. 

If the charge for a purchase was made fraudulently or improperly using a payment card number, its holder may demand the immediate cancellation of the charge. In such a case, the relevant debit and credit entries in the accounts of the provider and the holder will be made as quickly as possible. 

However, if the purchase was indeed carried out by the cardholder and the request for a refund was not due to exercising the right of withdrawal or cancellation, and therefore the charge was improperly demanded to be canceled, the cardholder will be liable to the Controller for any damages caused as a result of such cancellation. 

PayPal 

PayPal allows for secure and convenient online payments. The PayPal network is based on the existing financial infrastructure of bank accounts and credit cards to provide a global, real-time payment solution. PayPal is especially designed for those who are not satisfied with traditional payment mechanisms.

The Controller agrees to provide the service within a maximum of 60 business days, starting from the day following the request. 

The availability of services offered by the Controller may vary based on the service. In case of non-performance due to unavailability, the Controller will inform the client of this situation via email as soon as it becomes known. This notification will not exceed a maximum period of 30 days. The Controller may offer the client, without any price increase, a service with similar or superior characteristics, or unless justified and demonstrable reasons exist, the amounts paid for the canceled service will be refunded within the same period. 

Right of Withdrawal, Refunds, and Complaints 

The client will have a maximum period of thirty (30) calendar days to withdraw, starting from the day the contract is concluded, without any penalty or the need to provide a reason. 

The client will receive the total amount of the purchase, including the price of the product and shipping costs, within 14 calendar days from the date the returned goods are received at the warehouse. The refund will be processed using the same payment method used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise, and provided the consumer does not incur any fees as a result of the refund. 

The exercise of the right of withdrawal must be communicated via phone at 664876906, email at info@mohem.es, by sending a written notice to our postal address at EMILI POLIT, Nº 2, 08328, ALELLA, BARCELONA, and byvcompleting the withdrawal form.

  • Consumer’s and user’s signature(s) (only if this form is submitted in paper format)
  • Date 

In accordance with Article 103 of Law 3/2014 of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, the provision of services or goods made according to consumer specifications or clearly personalized, or which, by their nature, cannot be returned or are liable to deteriorate or expire quickly, are exempt from withdrawal. 

If the client requests the provision of the service to begin during the withdrawal period, they will be required to pay the proportional amount corresponding to the part of the service provided up to the moment they have communicated their withdrawal regarding the contract's subject matter.

Refund of Payment 

Refunds of amounts received from the client will be made using the same payment methods employed by the client, provided no other arrangement has been made. 

The Controller will refund the amounts paid by the client within 14 calendar days from the date on which the right of withdrawal was received. 

Complaints 

If the client wishes to file a complaint, the Controller’s establishment is located at EMILI POLIT, Nº 2, 08328, ALELLA, BARCELONA, or you may do so via email at info@mohem.es. 

Jurisdiction 

The Controller reserves the right to take any civil or criminal action deemed appropriate for the misuse of its website and contents or for breach of these terms and conditions. 

The relationship between the user and the provider shall be governed by the current legislation applicable within Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or go to the ordinary jurisdiction in compliance with the rules of jurisdiction and competence in this regard. The Controller’s domicile is at EMILI POLIT, Nº 2, 08328, ALELLA, BARCELONA, Spain.
